These Event Terms govern your application to, booking of, and attendance at any Creator House event, retreat, or trip (each an "Event"), operated by Tobias Loesch trading as Creator House ("Creator House", "we", "us"). By submitting an application, completing a booking, making a payment, or attending an Event, you ("Participant", "you") agree to be bound by these Terms in full. If you do not agree, do not apply, book, or attend.
These Terms apply alongside our Privacy Policy. Where these Terms and any marketing material, brochure, itinerary draft, or verbal description conflict, these Terms control.
Attendance at any Event is by application and personal selection only. Submitting an application does not guarantee acceptance or a place at any Event. Creator House selects participants at its sole discretion and may decline any application without giving a reason.
A place is only confirmed once you have received written confirmation from Creator House and paid any required fee or deposit.
Event fees, payment schedules, and deadlines are set out in your individual booking confirmation. Your place is not secured until payment (or an agreed deposit) has been received in full and confirmed by us.
Fees cover only the items expressly stated in your booking confirmation. Flights, visas, travel insurance, personal spending, and any item not expressly included remain your sole responsibility and cost.
All fees and deposits are non-refundable once paid. This applies regardless of the reason for cancellation, including a change of mind, personal circumstances, illness, denied visa or travel document, or any other reason on your side.
At our sole discretion, and only where requested in writing at least 30 days before the Event start date, we may instead offer to transfer your paid fee as credit toward a future Creator House Event, valid for 12 months from the original Event date, or allow you to transfer your place to another individual we approve. Offering this accommodation in one instance does not obligate us to offer it again.
If Creator House cancels an Event entirely before it starts, you will receive either a full refund or, at your election, credit toward a future Event. Creator House is not liable for any other cost, loss, or damage arising from a cancellation, including but not limited to flights, visas, or other travel arrangements you have made.
If you are a consumer resident in the EU or UK, any statutory right to cancel or receive a refund that cannot lawfully be excluded under your local consumer protection law is not affected by this section.
Creator House reserves the right to change the venue, accommodation, location, itinerary, schedule, activities, speakers, or any other element of an Event at any time, before or during the Event, for any reason, including but not limited to availability, safety, cost, weather, or operational necessity.
Any villa, property, or location shown in marketing material, on the website, in social media content, or in any prior edition is illustrative of the general standard and style of Creator House Events only. It is not a guarantee that a specific property will be used for any particular Event. A change of venue, including to a property of different size, layout, or amenities, does not constitute a material change entitling you to a refund, credit, or compensation, provided the replacement venue is reasonably comparable in standard.
Creator House Events involve travel, group living, physical activities, and time spent in a foreign country, which carry inherent risks including but not limited to accident, illness, injury, property loss or damage, adverse weather, and political or civil instability. By attending, you acknowledge and voluntarily accept these risks.
To the maximum extent permitted by applicable law, you release and discharge Creator House, Tobias Loesch personally, venue owners, and any Creator House staff, contractors, or partners from any and all claims, liabilities, losses, or damages arising from your participation in an Event, however caused, including negligence, except as set out below.
This waiver does not apply to, and nothing in these Terms excludes or limits liability for: death or personal injury caused by gross negligence or willful misconduct, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under applicable law.
By attending, you confirm that you are in good general health, are not aware of any medical condition that would make it unsafe for you to participate, and have consulted a physician if you have any doubt. You are responsible for disclosing any relevant medical condition, allergy, or dietary requirement to us in advance and for bringing any medication you may need.
Participants are expected to behave respectfully toward other participants, staff, venue owners, and the local community. Creator House may remove any participant from an Event at any time, without refund, for conduct that is unsafe, illegal, harassing, or significantly disruptive to the Event or other participants, at our sole reasonable discretion.
You are solely responsible for arranging and paying for your own flights, obtaining any visa or travel document required for your nationality, and holding adequate travel and medical insurance covering the full duration of the Event. Creator House is not liable for any cost or loss arising from a denied visa, missed flight, or inadequate insurance.
Creator House and its photographers, videographers, and content team may photograph and film participants throughout an Event. By applying, booking, or attending, you grant Creator House a worldwide, perpetual, irrevocable, royalty-free, transferable license to record, use, reproduce, edit, publish, distribute, and create derivative works from your name, image, voice, and likeness captured at an Event, in any medium now known or later developed (including but not limited to the Creator House website, social media, advertising, and press), for marketing, promotional, editorial, or commercial purposes, without further notice, compensation, or approval, and without time limit.
This license is a condition of attendance and has no general opt-out. If you have a specific, narrow request (for example, regarding a single sensitive image), raise it with us in writing and we will consider it at our discretion, but attendance itself constitutes your grant of the license described above.
You agree to indemnify and hold harmless Creator House and Tobias Loesch personally from any claim, liability, cost, or expense (including reasonable legal fees) arising from your breach of these Terms, your negligent or willful acts, or your violation of any applicable law during an Event.
Creator House is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disaster, pandemic, war, civil unrest, government action, flight cancellation, or venue unavailability. Where an Event is cancelled due to such circumstances, section 4 (Cancellation, Changes, and Refunds) governs any refund or credit.
To the maximum extent permitted by law, Creator House's total liability to you arising out of or in connection with an Event, however caused, is limited to the amount you paid for that Event. Creator House is not liable for indirect, incidental, or consequential loss, including loss of income, business opportunity, or profit.
Nothing in this section limits liability for death, personal injury, fraud, or any other liability that cannot be excluded or limited under applicable law.
These Terms are governed by the laws of Indonesia, without regard to conflict of law principles, unless a mandatory consumer protection law of your country of residence provides otherwise. Any dispute arising from these Terms or an Event shall first be attempted to be resolved informally by contacting us directly.
If you are a consumer resident in the EU or UK, mandatory consumer protection rights and access to courts under your local law remain unaffected by this section.
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. These Terms, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between you and Creator House regarding an Event, superseding any prior marketing material or verbal representation.
We may update these Terms from time to time. The version in effect at the time of your booking confirmation governs your Event.
